2. How to Exercise the Statutory Withdrawal Right
The withdrawal must be clearly declared to Mytuku within the applicable statutory period.
The consumer may exercise the right by sending an unambiguous statement informing us of the decision to withdraw from the contract.
The information requirements concerning the withdrawal right are governed in particular by Article 246a § 1(2) EGBGB.
3. Refunds Under German Law
Where a statutory withdrawal is validly exercised, the consequences of withdrawal are governed by § 357 BGB.
Generally, payments received from the consumer must be refunded within the statutory period. The refund is generally made using the same payment method used for the original transaction, unless otherwise agreed in accordance with the law.
Under § 357(4) BGB, the merchant may in certain circumstances withhold the refund until the goods have been returned or the consumer has provided evidence that the goods have been sent back.
Return shipping costs in a statutory withdrawal may be borne by the consumer where the consumer has been properly informed of this obligation in accordance with Article 246a § 1(2) EGBGB and § 357 BGB.
